1. Agreement and Scope
These Terms of Service ("Terms") govern your access to and use of the Yarashi platform (yarashi.com.au), operated by The Agile Foundry (trading as Yarashi) ("we", "us", "our").
By creating an account or using Yarashi, you confirm that you have read, understood and agree to these Terms and our Privacy Policy. If you do not agree, do not use the platform.
Governing law: These Terms are governed by the laws of New South Wales, Australia. Any dispute is subject to the non-exclusive jurisdiction of the courts of New South Wales, without prejudice to your rights as a consumer in your country of residence.
We may update these Terms. We will notify you of material changes at least 14 days before they take effect by email and in-platform notice. Continued use after that date constitutes acceptance.
2. The Service
Yarashi provides an AI-powered career intelligence platform. Core features include:
• Role Match — AI-scored job matching against your CV from live Australian job listings
• Skill Radar — Skills gap analysis comparing your CV to current job market demand
• Letter Builder — AI-generated cover letters tailored to specific roles
• Interview Coach — Role-specific interview questions with STAR-method answers
• Profile Boost — LinkedIn profile optimisation using AI
• My Pipeline — Application tracking and job search management
• Job Alerts — Email notifications for new matching roles
Free and Pro subscription plans are available. Features available on each plan are described on the platform at yarashi.com.au/platform. We may modify, add or remove features with reasonable notice to users.
AI-generated content: All content generated by Yarashi's AI features (scores, letters, answers, analyses) is provided as an informational tool to assist your job search. It does not constitute professional career, legal or employment advice. You are responsible for reviewing, editing and taking responsibility for any content you submit to employers.
3. Eligibility and Accounts
You must be at least 18 years of age to use Yarashi. By registering, you confirm you meet this requirement.
You agree to:
• Provide accurate, current and complete information at registration and keep it updated
• Maintain the security of your password — you are responsible for all activity under your account
• Notify us immediately at support@yarashi.com.au if you suspect unauthorised access
• Use one account per person — you may not create multiple accounts or impersonate another person
We reserve the right to suspend or terminate accounts that breach these requirements.
4. Subscriptions, Billing and Refunds
Free plan: Available to all registered users, subject to usage limits displayed on the platform.
Pro plan: Monthly or annual subscription granting higher usage limits and additional features. Pricing is displayed on the platform and invoiced in Australian Dollars (AUD).
Billing: By subscribing to Pro, you authorise us to charge your nominated payment method on each billing date. You will receive an invoice by email.
Cancellation: You may cancel your Pro subscription at any time via account settings. Cancellation takes effect at the end of the current billing period. You retain Pro access until that date.
Price changes: We will give 30 days' notice of price increases to existing Pro subscribers. You may cancel before the new price takes effect.
Australian Consumer Law — Consumer Guarantees: Our services come with guarantees that cannot be excluded under the ACL. You are entitled to:
• Services provided with due care and skill
• Services fit for the purpose we describe
• Redress (refund, re-supply or compensation) if we fail to meet these guarantees
Refunds: We provide refunds where the platform fails to deliver its core functionality and we cannot resolve the issue within a reasonable time. Refunds are not available for change of mind unless required by law. Nothing in these Terms excludes or modifies consumer guarantees under the ACL.
5. Acceptable Use
You agree not to use Yarashi to:
• Violate any applicable law, regulation or third-party rights
• Upload CV content or data belonging to another person without their explicit consent
• Attempt to gain unauthorised access to our systems or another user's account
• Scrape, copy, reverse-engineer or redistribute our platform, AI prompts or outputs for commercial purposes
• Use automated tools (bots, scrapers) to access or interact with the platform
• Introduce malware, viruses or other harmful code
• Impersonate another person or entity
• Use the platform for commercial recruitment purposes without our written agreement
Consequences: We may suspend or terminate accounts that breach these rules, without refund, and report activity to relevant authorities where required by law.
6. Your Content
Ownership: You retain ownership of all CV text, career information and other content you upload to Yarashi ("Your Content").
Licence: By uploading Your Content, you grant us a limited, non-exclusive, royalty-free licence to process it using our systems to provide the features you request. We do not claim ownership of Your Content, do not use it to train AI models, and do not share it beyond the sub-processors listed in our Privacy Policy.
Accuracy: You are responsible for ensuring Your Content is accurate, lawful and does not infringe any third party's rights.
Deletion: Upon account deletion, Your Content is removed from our systems within 30 days as described in our Privacy Policy.
Data portability: You may request a copy of your data at any time by emailing privacy@yarashi.com.au.
7. AI Content and No Employment Guarantee
You acknowledge and accept that:
• AI-generated content (scores, letters, answers, analyses) may contain errors, inaccuracies or information that is not suitable for your specific circumstances
• AI match scores are indicative only and do not reflect the hiring intentions of any employer
• We do not guarantee any particular job search outcome, interview, offer or employment from using the platform
• You must always review, personalise and take responsibility for AI-generated content before submitting it to any employer or third party
• We are not responsible for consequences arising from your use of AI-generated content in applications or interviews
Nothing in these Terms limits any liability that cannot be excluded by law, including liability for death or personal injury caused by our negligence, or liability under the ACL consumer guarantees.
8. Our Intellectual Property
Yarashi owns all intellectual property in the platform, including software, design, brand, logos, AI system architecture and prompts ("Our IP").
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the platform for your personal job search purposes in accordance with these Terms. This licence does not permit you to reproduce, distribute, modify, create derivative works from, or commercially exploit any part of Our IP without our written consent.
AI-generated outputs: To the extent AI-generated outputs contain original expression, you own the outputs generated for you using Your Content. We retain no rights in them.
9. Third-Party Content and Job Listings
Job listings on Yarashi are sourced from Adzuna and other third-party providers. We do not create, verify, endorse or take responsibility for the accuracy, legality or content of any job listing.
We are not party to any employment relationship or negotiation between you and any employer or recruiter. We are not responsible for:
• The conduct of employers, recruiters or third parties
• The outcome of any job application you make through or assisted by Yarashi
• The content or privacy practices of third-party websites linked from job listings
You interact with employers and third parties at your own risk.
10. Limitation of Liability
To the maximum extent permitted by law, and subject always to the Australian Consumer Law and your statutory consumer guarantees:
Liability cap: Our total aggregate liability to you for all claims arising from or related to your use of Yarashi is limited to the greater of: (a) the total fees you paid us in the 12 months preceding the claim, or (b) AUD $100.
Excluded loss types: We are not liable for any indirect, consequential, incidental, special, punitive or exemplary loss or damage, including lost profits, lost career opportunities, reputational damage or loss of data, even if we have been advised of the possibility of such loss.
These limitations do not apply to:
• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Any liability that cannot be limited or excluded under the ACL or applicable law
• Rights granted to you as a consumer under the ACL consumer guarantees
11. GDPR Specific Rights (EEA/UK Users)
If you are located in the European Economic Area or United Kingdom, the following additional terms apply:
Data controller: The Agile Foundry (trading as Yarashi) is the data controller of your personal data.
Legal bases: We process your data on the bases set out in our Privacy Policy — primarily contract performance and legitimate interests.
Your GDPR rights include: access, rectification, erasure, restriction, portability, objection, and the right not to be subject to solely automated decision-making with legal effects. Our AI features do not produce legally binding automated decisions — a human (you) reviews all outputs.
Supervisory authority: You have the right to lodge a complaint with your national Data Protection Authority or the Irish Data Protection Commission (our EU representative jurisdiction).
Data transfers: Your data is transferred to the United States under Standard Contractual Clauses. Details are in our Privacy Policy.

12. Suspension, Termination and Data Deletion
Your right to close your account: You may close your account at any time via account settings. We will delete your personal data within 30 days.
Our right to suspend: We may suspend your account immediately if you breach these Terms, engage in fraud, or if required to do so by law. Where technically feasible, we will notify you of suspension.
Our right to terminate for convenience: We may terminate the platform or your access with 30 days' notice. If we terminate for our convenience, we will provide a pro-rata refund of any prepaid subscription fees.
Effect of termination: Your licence to use the platform ends. Provisions that survive by their nature continue — including intellectual property, limitation of liability, dispute resolution and your data rights under our Privacy Policy.
13. Dispute Resolution
Step 1 — Contact us: Email support@yarashi.com.au. We aim to resolve complaints within 14 business days.
Step 2 — Australian consumer bodies: If unresolved, you may contact:
• NSW Fair Trading: fairtrading.nsw.gov.au
• Australian Competition and Consumer Commission (ACCC): accc.gov.au
• Office of the Australian Information Commissioner (OAIC): oaic.gov.au (privacy matters)
Step 3 — Courts: Disputes may be referred to a court of competent jurisdiction in New South Wales, Australia.
For EEA/UK users: Nothing in these Terms prevents you from seeking remedies in your country of residence under local consumer protection law.
14. General Provisions
Entire agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Yarashi regarding the platform and supersede all prior agreements.
Severability: If any provision is found unenforceable, it will be modified to the minimum extent necessary. The remaining provisions continue in full force.
No waiver: Our failure to enforce any right or provision is not a waiver of that right.
Assignment: You may not assign your rights or obligations under these Terms without our consent. We may assign our rights in connection with a merger, acquisition or sale of assets, with notice to you.
Force majeure: We are not liable for failure to perform our obligations due to events beyond our reasonable control.

Australian Consumer Law notice: Our services come with guarantees under the Australian Consumer Law that cannot be excluded. For major failures, you are entitled to a remedy. These Terms do not limit, exclude or modify rights you have under the ACL. If there is any inconsistency between these Terms and your rights under applicable consumer law, the consumer law prevails.
These Terms were prepared by Yarashi to comply with the Australian Consumer Law (Competition and Consumer Act 2010 (Cth)), the Privacy Act 1988 (Cth), the Privacy and Other Legislation Amendment Act 2024 (Cth), GDPR (EU 2016/679), UK GDPR, and general contract law in New South Wales. They do not constitute legal advice. We recommend obtaining independent legal advice from a qualified Australian solicitor as your platform, user base and commercial activities grow.
